RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING APPEAL OF PLANNING COMMISSION DENIAL OF PLANS TO
SUBDIVIDE A PREVIOUSLY MERGED PARCEL INTO TWO LOTS, TO
MOVE AN EXISTING THREE -UNIT RESIDENTIAL STRUCTURE ON TO
ONE OF THE PARCELS AND TO DECREASE THE NUMBER OF DWELLING
UNITS FROM THREE TO ONE ON PROPERTY IN THE R1 -D ZONE
(412 UNIVERSITY AVENUE - EUGENE STECZ)
WHEREAS:
1. E. Gary Schloh, on behalf of Eugene Stecz, has appealed a decision of the
Planning Commission as follows: denial of plans to subdivide a previously merged parcel
into two lots, to move an existing three -unit residential structure on to one of the parcels
and to decrease the number of dwelling units from three to one on property located in the
Rl -D Zone at 412 University Avenue and owned by Eugene Stecz (Architecture and Site
Application S- 79 -16A and Subdivision Application M- 90 -5); and
2. A public hearing was held by the Town Council on June 18, 1990; and
3. E. Gary Schloh, on behalf of Eugene Stecz, has indicated that the property owner
wishes to withdraw the appeal.
BE IT RESOLVED:
1. The Town Council hereby finds that no evidence or testimony was presented that
the decision of the Planning Commission was in error and the applicant wishes to withdraw
the appeal of the decision of the Commission in this matter.
2. Based on the foregoing finding, the Town Council hereby denies the appeal and
denies Architecture and Site Application S- 79 -16A and Subdivision Application M -90 -5.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 2nd day of JULY, 1990 by the following vote.
