A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN
OF LOS GATOS ESTABLISHING RULES AND
REGULATIONS FOR COMMERCIAL FILMING PERMIT PROCESS
RESOLVED, that the following rules and regulations are hereby adopted to establish
a procedure for the obtaining of a commercial filming permit:
1. Advance Notice for Approval: An applicant will be required to submit a
permit request twenty (20) working days prior to the date on which such person desires to
conduct an activity for which a permit is required.
2. Clean Up: The permittee shall conduct operations in an orderly fashion with
continuous attention to the storage of equipment not in use and the cleanup of trash and
debris. The area used shall be cleaned of trash and debris upon completion of shooting at
the scene and restored to the original condition before leaving the site.
A cleaning deposit of two hundred fifty dollars ($250.00) shall be posted upon
issuance of the permit. This deposit will be refunded upon satisfactory evidence of the
clean up operation.
3. Filming on Private Property: A permittee is required to obtain the property
owner's written permission, consent, and /or lease for use of property not owned or
controlled by the Town.
4. Flood Control: When filming in a flood control channel, a permittee must
vacate channel when permit indicates because of water releases. When filming in or on
flood control properties, the flood control agency must be named as an additional insured
and permits obtained from the flood control agency.
5. Public Works Department (Roads and Streets): If the permittee must park
equipment, trucks, and /or cars in zones that will not permit it, temporary "No Parking" signs
must be posted by the Town. The permittee must also obtain permission to string cable
across sidewalks, or from generator to service point.
6. Traffic Control: For filming that would impair traffic flow, permittee must
use Los Gatos law enforcement personnel, unless otherwise stipulated by the Chief of
Police, and comply with all traffic control requirements deemed necessary.
a. A permittee shall furnish and install advance warning signs and any
other traffic control devices in conformance with the Manual of Traffic
Controls. State of California Department of Transportation. All
appropriate safety precautions must be taken.
b. Any restrictions or alterations of normal traffic flow must be approved
by the Chief of Police. This includes the length of time, day of week
and time of day that traffic may be restricted or altered.
C. Traffic shall not be detoured across a double line without prior
approval of the Chief of Police.
d. Unless authorized by the Town, all camera cars must be driven in the
direction of traffic and must observe all traffic laws.
e. Any emergency road work or construction by Town crews and /or
private contractors, under permit or contract to the appropriate
department, shall have priority over filming activities.

7. Parking Lots:
When parking in a parking lot, a permittee may be billed
according to the current rate schedule established by the Town.
In order to assure the
safety of citizens in the surrounding community, access roads, which serve as emergency
service roads, must never be blocked.
8. Appeal of Denial: Any person denied a permit pursuant to these provisions
may appeal to the Town Manager in writing within ten (10) days from such action stating
reasons why the permit should be granted. The Town Manager may grant or deny the
permit and such decision shall be final upon the applicant.
9. Non - Transferability of Permit: No permit issued under this process may be
sold, assigned, mortgaged or otherwise transferred.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 18th day of JUNE, 1990, by the following vote:
