RESOLUTION OF THE TOWN OF LOS GATOS DENYING
APPEAL OF PLANNING COMMISSION IN GRANTING
APPROVAL OF PLANS FOR A SECOND -STORY ADDITION
TO A SINGLE - FAMILY RESIDENCE IN THE R- 1:8000 ZONE
(73 MARIPOSA COURT - RENIE LOCKE)
WHEREAS:
1. Joanne Maloney, Loree Ferla, Hans Frick, Thomas Gee and James Smith have
appealed a decision of the Planning Commission as follows: granting approval of plans for
a second -story addition to a single - family residence in the R- 1:8000 zone on property
located at 73 Mariposa Court (Second -Story Addition Application X- 89 -26); and
2. A public hearing was set before the Town Council for February 5, 1990 and
continued to and held on March 5, 1990.
BE IT RESOLVED:
1. The Town Council hereby finds that no evidence or testimony was presented that
the decision of the Planning Commission was in error.
2. The Town Council hereby further finds that the application follows the Town
guidelines for second stories.
3. Based on the foregoing findings, the Town Council hereby denies the appeal and
grants Second -Story Application X- 89 -26.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 19th day of March, 1990 by the following vote.
COUNCIL MEMBERS:
AYES: Joanne Benjamin, Eric D. Carlson and Robert L. Hamilton.
NAYS: Brent N. Ventura and Mayor Thomas J. Ferrito.
