RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING APPEAL OF A DECISION OF THE PLANNING COMMISSION IN
DENYING A REQUEST TO SERVE BEER AND WINE AS PART OF AN
EXISTING RESTAURANT OPERATION IN THE C -2 LHP ZONE
(27 EAST MAIN STREET - ILHAM AND MINA ARIF)
WHEREAS:
1. Ilham Arif and Mina Arif have appealed a decision of the Planning
Commission as follows: denial of a request to serve beer and wine as part of an existing
restaurant operation in the C -2 LHP zone on property located at 27 East Main. Street and
owned by Stephen Hou and applied for by Ilham and Mina Arif (Conditional Use Permit
Application U- 83 -28A); and
2. A public hearing was held by the Town Council on August 21, 1989 and
continued to November 20, 1989 and to February 20, 1990; . and
3. On October 17, 1989 the building at 27 East Main Street was severely
damaged by earthquake and on November 20, 1989 the Town Council approved the
relocation of the restaurant to 217 North Santa Cruz Avenue but no occupancy was taken
by the applicant.
BE IT RESOLVED:
1. The Town Council hereby finds that 27 East Main Street property is under
reconstruction and the issue of service of beer and wine will be considered by the Town
Council as part of a general policy decision at a later date.
2. Based on the foregoing, the appeal is hereby denied and Conditional Use
Permit Application U- 88 -28A is hereby denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 5th day of March, by the following vote.
