RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
GRANTING APPEAL OF PLANNING COMMISSION DECISION
TO APPROVE PLANS FOR A TWO -STORY ADDITION TO AN EXISTING
ONE -STORY RESIDENCE IN THE R -1D -LHP ZONE AND REMANDING
THE APPLICATION TO THE PLANNING COMMISSION
(243 BACHMAN AVENUE - ALFIE GILBERT /CHRISTINA BURNSIDE)
WHEREAS:
1. Christina Burnside has appealed a decision of the Planning Commission as
follows: approval of plans for a two -story addition to an existing one -story residence in the
R -1D -LHP zone on property located at 243 Bachman Avenue and owned by Alfie Gilbert
and application by E. Gary Schlott (Architecture and Site Application S- 89 -55); and
2. A public hearing was held by the Town Council on December 4, 1989.
BE IT RESOLVED:
1. The Town Council hereby finds that the decision of the Planning Commission was
in error because of the failure to consider that the rear portion of the proposed structure
along the property line is visibly intrusive to the neighbor and causes a significant shadow
impact on the adjacent property and the pruning and possible demise of the Bay tree would
eliminate screening of the structure.
2. Based on the foregoing finding, the Town Council hereby grants the appeal and
remands Architecture and Site Application S -89 -55 to the Planning Commission for review
of alternative plans to address the concerns of the impact of the project on the adjacent
property.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 18th day of DECEMBER, 1989 by the following vote.
