RESOLUTION OF THE TOWN OF LOS GATOS DENYING APPEAL OF
DECISION OF PLANNING COMMISSION IN DENYING REQUEST
FOR APPROVAL OF PLANS TO DEMOLISH AN EXISTING MOTEL
AND TO CONSTRUCT EIGHT RESIDENTIAL CONDOMINIUM UNITS
ON PROPERTY IN THE LM ZONE

1. Terry McElroy has appealed a decision of the Planning Commission as follows:
denial of request for approval of plans to demolish an existing motel and to construct eight
residential condominium units on property in the LM zone located at 664 North Santa Cruz
Avenue and owned by John H. and Nola Heindel and Anne Bajace by applicant Andre
Roos (Conditional Use Permit U -89 -1 and Architecture and Site Application 5- 89 -10); and
2. A public hearing was held by the Town Council on November 20, 1989.
BE IT RESOLVED:
1. The Town Council hereby finds that no evidence or testimony was presented that
the decision of the Planning Commission was in error.
2. The Town Council hereby further finds that the LM zone was intended for
resident - serving businesses and that mixed use should not be considered on a spot basis.
3. Based on the foregoing findings, the Town Council hereby denies the appeal and
denies Conditional Use Permit U -89 -1 and Architecture and Site Application 5- 89 -10.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the TownCouncil of the Town of
Los Gatos, California, held on the 4th day of DECEMBER, 1989 by the following vote.
