RESOLUTION OF THE TOWN OF LOS GATOS DENYING APPEAL OF
DECISION OF PLANNING COMMISSION IN DENYING REQUEST TO
MODIFY THE DEVELOPMENT STANDARDS OF AN EXISTING PLANNED
DEVELOPMENT TO PERMIT CHANGES TO REQUIRED YARDS (BUILDING
SETBACKS) ON PROPERTY IN THE HR -1:PD ZONE
(15744 OAK KNOLL COURT - GEORGE STRAB AND GABOR DUVON)
WHEREAS:
1. George Strab and Gabor DuVon have appealed a decision of
the Planning Commission as follows: denial of request to modify
the development standards of an existing planned development to
permit changes to required yards (building setbacks) on property
in the HR -1:PD zone located at 15744 Oak Knoll Court and owned by
George Strab and Gabor DuVon (Zoning Application Z- 81 -6B); and
2. A public hearing was held by the Town Council on November
20, 1989.
BE IT RESOLVED:
1. The Town Council hereby finds that no evidence or
testimony was presented that the decision of the Planning
Commission was in error.
2. The Town Council hereby further finds that decision of the
Planning Commission to approve the amendment to Ordinance 1551 to
reflect approved setbacks should be upheld and finds the zone
change consistent with the General Plan.
3. Based on the foregoing findings, the Town Council hereby
denies the appeal, denies Zoning Application Z -81 -6B and orders
that the Applicant remove the unlawful projection by March 5, 1990.
Pursuant to Los Gatos Town Code Section 1 -15, the time for
seeking judicial review for the Town Council decision is governed
by California Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council
of the Town of Los Gatos, California, held on the 4th day of
December, 1989 by the following vote.
