1989-230-Approval Of A Lot Line Adjustment To Relocate An Interior Property Line On Property In The RMH ZoneRESOLUTION 1989 - 230 RESOLUTION OF THE TOWN OF LOS GATOS DENYING APPEAL OF PLANNING COMMISSION IN DENYING REQUEST FOR APPROVAL OF A LOT LINE ADJUSTMENT TO RELOCATE AN INTERIOR PROPERTY LINE ON PROPERTY IN THE RMH ZONE (484 WOODLAND AVENUE - MALCOLM McNELLY) WHEREAS: 1. Joseph M. Gughemetti, on behalf of Malcolm McNelly, has appealed a decision of the Planning Commission as follows: denial of a request for approval of a lot line adjustment to relocate an interior property line on property in the RMH zone located at 484 Woodland Avenue and owned by J. McNelly (Subdivision Application M- 88 -17); and 2. A public hearing was held by the Town Council on November 20, 1989. BE IT RESOLVED: 1. The Town Council hereby finds that the Appellant desires to withdraw the appeal. 2. The Town Council hereby further finds that the staff report supports the actions of the Planning Commission and that the Planning Commission decision was correct. 3. Based on the foregoing, the appeal is hereby denied and Subdivision Application M -88 -17 is hereby denied. Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review for the Town Council decision is governed by California Code of Civil Procedure Section 1094.6. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 4th day of DECEMBER, 1989 by the following vote.
