RESOLUTION OF THE TOWN OF LOS GATOS DENYING
APPEAL OF THE PLANNING COMMISSION APPROVAL TO
CONSTRUCT A SECOND -STORY ADDITION TO AN EXISTING
RESIDENCE IN THE R -1D -LHP ZONE
(315 NICHOLSON AVENUE - NICHOLAS MUHLHAUSER)
WHEREAS:
A. Nicholas Mulhauser has appealed a decision of the Planning
Commission as follows: approval of plans to construct a second -
story addition to an existing residence in the R -1D -LHP zone on
property located at 315 Nicholson Avenue and owned by Nicholas
Mulhauser (Architecture and Site Application S- 89 -9); and
B. A public hearing was held by the Town Council on November
6, 1989.
BE IT RESOLVED:
A. The Town Council hereby finds that the Appellant no longer
wishes to proceed with the appeal and seeks to withdraw it.
B. The Town Council hereby further finds that the findings
made by the Planning Commission as required by Zoning Ordinance
Section 4.86.180 for approving development in a historical zone and
as required by Section 3.65.040 for approval of demolition are
correct and adopts said findings.
C. The Town Council hereby denies the appeal and grants
Architecture and Site Application S -89 -9 subject to the following
conditions:
TO THE SATISFACTION OF THE TOWN ENGINEER:
1. The public alley adjacent to the site shall be repaved
from Nicholson Avenue to the extension of the southerly property
line.
Pursuant to Los Gatos Town Code Section 1 -15, the time for
seeking judicial review for the Town Council decision is governed
by California Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council
of the Town of Los Gatos, California, held on the 20th day of
November, 1989 by the following vote.
