1989-225-Vacate A Portion Of Public Right-Of-Way Called New York AvenueRESOLUTION 1989 -225 TOWN OF LOS GATOS RESOLUTION OF INTENTION TO VACATE A PORTION OF PUBLIC RIGHT -OF -WAY CALLED NEW YORK AVENUE (FROM THE STATE RIGHT -OF -WAY FENCE TO 230 FEET SOUTHEASTERLY) RESOLVED: 1. It is the intention of the Town Council to vacate, under the provisions of Division 9, Part 3 (Sections 8300 through 8331) of the Streets and Highways Code, a portion of a public road right -of -way situated in the Town of Los Gatos, County of Santa Clara, State of California, consisting of a strip of land approximately 230 ft. long containing approximately 13,305 sq. ft. (.31+ AC) located on New York Avenue with its northwesterly terminus lying on the state right -of -way line, including said roadway from said state right -of -way line to approximately 230 ft. southeasterly, more particularly described on Exhibit "A" entitled "Description of Public Roadway to be Abandoned (Portion of New York Avenue - from the State right -of -way fence to 230+ ft. southeasterly) ",copies of which are attached hereto. Said Exhibits show the particulars as to the proposed abandonment, and are available for public inspection in the Office of Town Clerk of Town of Los Gatos, Civic Center, 110 East Main Street, Los Gatos, California. 2. An Ingress- Egress Easement to the Los Gatos Youth Park, Inc. as well as Public Service Easements, as required, shall be dedicated over the area to be abandoned. 3. December 18, 1989, in the Council Chambers of the Civic Center, 110 East Main Street, Los Gatos, California, the Town Council will hold a public hearing to consider whether or not the right -of -way is necessary for present or prospective public use. The meeting will begin at 7:30 P.M. All persons interested are invited to attend and be heard. 4. The Town Clerk is authorized, and is hereby directed to publish a copy of this resolution in a newspaper of general circulation, published and circulated in the Town of Los Gatos, within fifteen (15) days after the date of its adoption. 5. The Mayor of the Town of Los Gatos is authorized, and is hereby directed to execute that document entitled, "Notice of Abandonment" of a portion of Public Right -of- Way ", a copy of which is attached hereto, and the Town Engineer is authorized, and is hereby directed to conspicuously post three (3) copies of said Notice, not more than 300 feet apart, on at least fourteen (14) days before the date of the public hearing above designated. Thence leaving said point and along said northeasterly right -of -way line S 60' 33' 54" E. 208.20 ft. to a point on said northeasterly right -of -way line of New York Avenue, said point is also parallel with and 60.00 at right angles from the southwesterly right - of -way line of New York Avenue. Thence leaving said point and the northeasterly right -of -way line, S 29' 26' 06" W, 60.00 ft. to the point of beginning. A copy of said Resolution No. 1989 -225, and a map entitled, "PLAT TO ACCOMPANY DESCRIPTION OF NEW YORK AVENUE ABANDONMENT ", showing the particulars as to the proposed abandonment are on file in the Office of the Town Clerk of the Town of Los Gatos, Civic Center, 110 E. Main Street, Los Gatos, California, and are available for inspection during regular business hours. NOTICE IS FURTHER GIVEN that on December 18, 1989, in the Council Chambers of the Civic Center, 110 E. Main Street, Los Gatos, California, the Town Council will hold a public hearing on the question of whether or not the right -of -way is necessary for present or prospective public use.
