RESOLUTION OF THE TOWN OF LOS GATOS AUTHORIZING
TOWN ENGINEER TO ISSUE A REVOCABLE ENCROACHMENT PERMIT
TO MAINTAIN A CONCRETE BLOCK RETAINING WALL WITHIN THE
EMERGENCY ACCESS EASEMENT AT 16350 BLACKBERRY HILL ROAD
WHEREAS, the property owners at 16350 Blackberry Hill Road have
installed a portion of their concrete block retaining wall within the Emergency
Access Easement.
WHEREAS, the Town has determined that the property owner's wall
encroachment poses no threat to public safety.
WHEREAS, the property owners agree to hold the Town harmless from any
claim of liability resulting from encroachment of the privately owned wall into
the Emergency Access Easement.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Los
Gatos that the Town Engineer is hereby authorized to execute the Revocable
Encroachment Permit for the maintenance of a a portion of a concrete block re-
taining wall within the Emergency Access Easement at 16350 Blackberry Hill
Road, a copy of which is attached hereto, as Exhibit A, on behalf of the Town.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos held on 7th day of August, 1989 by the following vote:
