RESOLUTION OF THE TOWN OF LOS GATOS REMANDING
TO THE DEVELOPMENT REVIEW COMMITTEE AND THE
PLANNING COMMISSION THE APPEAL OF PLANNING
COMMISSION DECISION TO UPHOLD THE DECISION OF
THE PLANNING DIRECTOR IN DENYING AN APPLICATION
FOR A SECOND -STORY ADDITION TO A SINGLE FAMILY
RESIDENCE IN THE R -11) ZONE
(620 SAN BENITO - AARON L. KATZ AND CAROLYN GIVENS)
WHEREAS:
1. Aaron L. Katz has appealed a decision of the Planning Commission as
follows: upholding the decision of the Planning Director in denying an application for a
second -story addition to a single family residence in the R -11) zone on property located at
620 San Benito Avenue and owned by Aaron L. Katz and Carolyn Givens (Architecture and
Site Approval S- 89 -14); and
2. A public hearing was held by the Town Council on June 19, 1989.
BE IT RESOLVED:
1. The Town Council hereby finds that the Planning Commission decision was
correct; however, the applicant could redesign the project to minimize the impact on the
streetscape and is willing to do so.
2. Based on the following finding, the Town Council hereby remands the appeal
of Architecture and Site Application 5 -89 -14 to the Planning Commission for review by the
Development Review Committee to consider a redesign that would minimize the impact
on the streetscape.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 10th day of July , 1989 by
the following vote.
