RESOLUTION OF THE TOWN OF LOS GATOS REMANDING
TO THE DEVELOPMENT REVIEW COMMITTEE AND THE
PLANNING COMMISSION THE APPEAL OF PLANNING
COMMISSION DENIAL OF PLANS FOR A REMODEL AND
SECOND STORY ADDITION TO AN EXISTING SINGLE -
FAMILY RESIDENCE IN THE R -1D -LHP ZONE AND
REFERRING APPEAL TO THE PLANNING COMMISSION
(304 Nicholson Avenue - Barbara Herlihy)
WHEREAS:
1. Barbara Herlihy has appealed a decision of the Planning Commission as
follows: denial of plans for a remodel and second story addition to an existing single - family
residence in the R -1D -LHP zone on property located at 304 Nicholson Avenue and owned
by Barbara Herlihy (Architecture and Site Application 5- 89 -2);
2. A public hearing was scheduled for June 5, 1989 and continued to and held
on June 19, 1989 by the Town Council.
BE IT RESOLVED:
1. The Town Council hereby finds that although the Planning Commission
decision was correct in that the Commission focused on the mass and volume of the
proposed project, the process may have been clouded by the testimony presented.
2. Based on the foregoing finding, the Town Council hereby remands the appeal
of Architecture and Site Application 5 -89 -2 to the Planning Commission with review by
the Development Review Committee to consider that the mass of the project be reduced
to permit a modest addition to the structure.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 10th day of July 1989 by
the following vote.
