RESOLUTION OF THE TOWN OF LOS GATOS DENYING APPEAL OF
PLANNING COMMISSION DENIAL OF A BUILDING PERMIT FOR A
SECOND STORY ADDITION TO AN EXISTING SINGLE STORY
RESIDENCE IN THE R -11) ZONE
(54 CHESTER STREET - DONALD D. O'BRIEN)
WHEREAS:
Rick Raynes, on behalf of Donald O'Brien, has filed a decision of the Planning
Commission as follows: denial of building permit for a second story edition to an existing
single story residence in the R -11) Zone on property located at 54 Chester Street and
owned by Donald P. O'Brien (Architecture and Site Application S- 88 -51); and
2. A public hearing was scheduled before the Town Council for May 12, 1989
and due to lack of a quorum, was continued to and held on May 15, 1989.
BE IT RESOLVED:
1. The Town Council hereby finds that no evidence or testimony was presented
that the decision of the Planning Commission was in error.
2. Based on the foregoing finding, the appeal is hereby denied and Architecture
and Site Application S -88 -51 is hereby denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 5 day of June , 1989 by the following vote.
