RESOLUTION OF THE TOWN OF LOS GATOS AUTHORIZING AND DIRECTING
THE TOWN TO DISPOSE OF LAND BY A QUITCLAIM DEED TO FACILITATE
NECESSARY LAND ACQUISITION FOR THE TOWN OF LOS GATOS DOWNTOWN
PARKING ASSESSMENT DISTRICT AND AUTHORIZING MAYOR TO EXECUTE
QUITCLAIM DEED
WHEREAS, The Town of Los Gatos desires to acquire certain real
property for purpose of a public improvement described as the Town of Los Gatos
Downtown Parking Assessment District Parking Structure; and
WHEREAS, 51 University Avenue, a California General Partnership, has
executed a Right of Way Agreement with the Town and execute a Grant Deed and
Grant of Easement to convey to the Town the real property sought to be
acquired; and
WHEREAS, paragraph 12 of the Town of Los Gatos Right of Way Agreement
with 51 University Avenue states that prior to recordation of the deed
accompanying said agreement, Town agrees to execute and record a quitclaim
deed, conveying to Grantor all its rights, title and interest in and to that
certain tax deed recorded in January, 1939, in Book 916, Page 84, Official
Record of Santa Clara County; and
WHEREAS, the Town by and through said tax deed owns fee title to a
parcel located within the real property sought to be acquired and described as
follows: "10 foot driveway in the real of lot on N.W. corner of Elm Street and
University Avenue" and recorded in Book 916, page 84, Official Records of Santa
Clara County; and
WHEREAS, the parcel held by the Town is not dedicated to any public
use; and
WHEREAS, it is necessary that the Town quitclaim its interest in the
parcel in order to facilitate the acquisition of the land for construction of
the parking structure on parking lot No. 4 and to comply with the provisions of
the agreement.
NOW, THEREFORE BE IT RESOLVED that the Town Council of the Town of Los
Gatos finds and determines and hereby declares that the parcel described herein
is not dedicated to public use.
BE IT FURTHER RESOLVED that the Town Council of the Town of Los Gatos
hereby approves and authorizes the Town to dispose of the parcel described
herein by quitclaim deed to facilitate the necessary land acquisition for the
Town of Los Gatos Downtown Parking Assessment District and authorizes the Mayor
to execute a quitclaim deed to subject parcel, a copy of which is attached
hereto as Exhibit A.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the ist day of May
1989 by the following vote.
