A RESOLUTION OF INTENTION TO VACATE BOONES LANE
LOCATED BETWEEN ELM STREET AND GRAYS LANE FOR CONSTRUCTION
OF THE DOWNTOWN PARKING ASSESSMENT DISTRICT PARKING STRUCTURE
RESOLVED:
1. It is the intention of the Town Council to vacate, under the provisions of
Division 9, Part 3 (Sections 8300 through 8331) of the Streets and Highways Code, an
alley situated in the Town of Los Gatos, County of Santa Clara, State of California,
consisting of a strip of land approximately 442 feet long containing approximately
9724 square feet located along Boones Lane between Elm Street and Grays Lane, and
more particularly described in Exhibit "A" (Description of Boone Lane to be
Abandoned by the Town of Los Gatos), and Exhibit "B" (Plat to Accompany Description
of Boones Lane Abandonment), copies of which are attached hereto. Said Exhibits
show the particulars as to the proposed abandonment, and are available for public
inspection in the Office of the Town Clerk of the Town of Los Gatos, Civic Center,
110 East Main Street, Los Gatos, California.
2. Public utility easements shall be retained over the area to be abandoned.
3. Ingress /Egress will be maintained to all properties with frontage along the
abandonment.
4. On May 1, 1989, in the Council Chambers of the Civic Center, 110 East Main
Street, Los Gatos, California, the Town Council will hold a public hearing to
consider whether or not the easement is necessary for present or prospective public
use. The meeting will begin at 7:30 P.M. All persons interested are invited to
attend and be heard.
5. The Town Clerk is authorized, and is hereby directed to publish a copy of
this resolution in a newspaper of general circulation, published and circulated in
the Town of Los Gatos, within fifteen (15) days after the date of its adoption.
6. The Mayor of the Town of Los Gatos is authorized, and is hereby directed to
execute that document entitled, "Notice of Abandonment of Boone Lane from Elm Street
to Grays Lane," a copy of which is attached hereto, and the Town Engineer is
authorized, and is hereby directed to conspicuously post three (3) copies of said
Notice, not more than 300 feet apart, on at least ten (10) days before the date of
the public hearing above designated.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos held on 3rd day of April, 1989 by the following vote:
