RESOLUTION OF THE TOWN OF LOS GATOS
GRANTING APPEAL OF PLANNING COMMISSION DENIAL OF
REQUEST FOR APPROVAL OF A SECONDARY DWELLING UNIT
ON PROPERTY IN THE "0" (OFFICE) ZONE

1. Eleanor Mattiuz has appealed a decision of the Planning Commission
as follows: denial of a request for approval of a secondary dwelling unit on
property in the "0" (Office) Zone located at 15894 Winchester Boulevard and
owned by Eleanor Mattiuz; and
2. A public hearing was held by the Town Council on March 6, 1989.
NOW, THEREFORE BE IT RESOLVED:
1. The Town Council hereby finds that the application for a secondary
dwelling permit was made prior to the deadline of December 31, 1988 but that no
application fee was submitted therewith.
2. The Town Council hereby further finds that the applicant desires
to have the secondary dwelling unit brought into conformance with health and
safety standards as set forth in the Housing Code and that, in so doing, a
housing unit would be preserved.
3. Based on the foregoing findings, the Town Council hereby grants
the appeal and directs the applicant to submit the required application fee in
the amount of $500 and to bring the unit into compliance with the Town Housing
Code, to the satisfaction of the Building Official, prior to the issuance of
any secondary dwelling unit permit.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 20 day of MARCH
1989 by the following vote.
