RESOLUTION OF THE TOWN OF LOS GATOS DENYING APPEAL OF PLANNING
COMMISSION DECISION DENYING PERMISSION TO MAINTAIN A DRIVEWAY
LESS THAN REQUIRED WIDTH, MAINTAIN AN EXISTING 14 -UNIT APARTMENT
BUILDING, AND APPROVAL OF PLANS TO CONSTRUCT A NINE -SPACE PARKING
LOT ON PROPERTY IN THE R- M:5 -12 ZONE

WHEREAS:
1. Charles D. Tuzar, Jr. has appealed a decision of the Planning
Commission as follows: denial of permission to maintain a driveway of less
than the required width, maintain an existing 14 -unit apartment building, and
approval of plans to construct a nine -space parking lot on property in the
R- M:5 -12 Zone on property located at 167 Villa Avenue and owned by Charles
Tuzar, Jr. (Variance Application V -86 -6, Conditional Use Permit U -86 -19 and
Architecture and Site Application S- 65 -14A); and

2. A public hearing was held by the Town Council on February 21,
BE IT RESOLVED:
1. The Town Council hereby finds that no evidence or testimony was
presented that the decision of the Planning Commission was in error.
2. Based on the following finding, the appeal is hereby denied and
Variance Application V -86 -6, Conditional Use Permit U -86 -19 and Architecture
and Site Application S- 65 -14A are hereby denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review for the Town Council decision is governed by California Code of
Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 6th day of February
1989 by the following vote.
