1988-086-Denial Of Request For Approving Plans For Construction Of Mini-Warehouse Storage Facility And For Permission To Have A Single Family Residence For Use By A Resident Manager On Property In The LM ZoneRESOLUTION NO: 1988 -86 RESOLUTION DENYING APPEAL OF PLANNING COMMISSION DENIAL OF REQUEST FOR APPROVAL OF PLANS FOR CONSTRUCTION OF A MINI - WAREHOUSE STORAGE FACILITY AND FOR PERMISSION TO HAVE A SINGLE FAMILY RESIDENCE FOR USE BY A RESIDENT MANAGER ON PROPERTY IN THE LM ZONE (761 UNIVERSITY AVENUE - PUBLIC STORAGE, INC.) WHEREAS: 1. Patrick J. McGaraghan, counsel for Public Storage, Inc., filed an appeal of a decision of the Planning Commission as follows: denial of request for approval of plans for construction of a mini - warehouse storage facility and for permission to have a single family residence for use by a resident manager on property in the LM Zone on property located at 761 University Avenue, owned by Jon P. Anderson and application by John Knott for Public Storage, Inc. (Architecture and Site Application S- 78 -7A, Conditional Use Permit Application U -78 -3A and Subdivision Application M- 87 -8); and 2. A public hearing was set for the Town Council for April 4, 1988 and continued to and held on May 2, 1988. BE IT RESOLVED: 1. The Town Council hereby finds that the Planning Commission decision denying the project should be upheld because the project does not meet the intent of the Zoning Ordinance covering the LM Zone. Zoning Ordinance Section 4.72.010 provides that the intent of the LM Zone is for small scale light industrial, repair and service - oriented activities that provide services to Town residents in addition to retailing, service and administrative activities. The proposed project is not small scale in that it merges five (5) lots into one, thus eliminating current small scale resident serving businesses and the potential development of others. 2. Based on the foregoing, the appeal is hereby denied and Architecture and Site Application S- 78 -7A, Conditional Use Permit Application U -78 -3A and Subdivision Application M -87-8 are hereby denied. Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review for the Town Council decision is governed by California Code of Civil Procedure Section 1094.6. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 16 day of May 1988 by the following vote.
