RESOLUTION DENYING APPEAL OF PLANNING COMMISSION
DECISION TO REVOKE ALL ZONING APPROVALS ON PROPERTY
IN THE LM ZONE FOR EXPANDING UNLAWFULLY
(720 UNIVERSITY AVENUE - ELEANOR NILSSON)
WHEREAS:
1. George Tobin, counsel for Eleanor Nilsson, has appealed a
decision of the Planning Commission as follows: Decision to revoke all
zoning approvals on property in the LM Zone for expanding unlawfully
located at 720 University Avenue and owned by Eleanor Nilsson
(Architecture and Site Applications S -75 -50 and S- 75-50A); and
2. A public hearing was held by the Town Council on December 7,
1987 and on February 1, 1988.
BE IT RESOLVED:
1. The Town Council hereby finds there was no evidence or
testimony presented that the Planning Commission erred and that the appeal
is moot since appellant has no existing approvals to revoke.
2. Based on the foregoing finding, the appeal is hereby denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review for the Town Council decision is governed by California
Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 16 day of February
1988 by the following vote.
