RESOLUTION DENYING APPEAL OF PLANNING COMMISSION DENIAL
OF A REQUEST FOR TREE REMOVAL IN THE R- 1:8,000 ZONE
(828 LILAC WAY - STEVEN & KAREN FRANZA)
WHEREAS:
1. Karen Franza has appealed a decision of the Planning
Commission as follows: Denial of a request for tree removal in the
R- 1:8,000 Zone on property located at 828 Lilac Way and owned by Steven
and Karen Franza; and
2. A public hearing was scheduled for November 2, 1987, continued
to December 21, 1987 and continued to and held on January 19, 1988.
BE IT RESOLVED:
1. The Town Council hereby finds that no testimony was presented
and no evidence was presented that the Planning Commission decision was in
error.
2. Based on the foregoing the appeal is hereby denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review for the Town Council decision is governed by California
Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 1 day of February
1988 by the following vote.
