1988-020-Denial Of Request For Approval Of A Two Lot Subdivision Of 1.26 Acres Of Property In The R-1:20,000 ZoneRESOLUTION NO: 1988 -20 RESOLUTION REMANDING TO PLANNING COMMISSION THE APPEAL OF PLANNING COMMISSION DENIAL OF REQUEST FOR APPROVAL OF A TWO (2) LOT SUBDIVISION OF 1.26 ACRES OF PROPERTY IN THE R- 1:20,000 ZONE (58 ALPINE AVENUE - ROSALIE D. LINCOLN) WHEREAS: 1. Stephen M. Rice, on behalf of Rosalie D. Lincoln, has appealed a decision of the Planning Commission as follows: Denial of subdivision application M -87-2 requesting approval of a two (2) lot subdivision of 1.26 acres in the R- 1:20,000 zone on property located at 58 Alpine Avenue and owned by Rosalie D. Lincoln; 2. A public hearing was scheduled by the Town Council for July 20, 1987, and at the request of the applicant, was continued to and held on August 3, 1987. Adoption of the resolution of the appeal was set for August 17, 1987 Town Council meeting and continued to September 8, 1987, and continued to September 21, 1987 and continued to October 19, 1987. On October 19, 1987 the Town Council voted to reconsider the matter and set the appeal for public hearing on December 7, 1987. The hearing was continued to December 21, 1987 on which date a public hearing was held by the Town Council. IT IS HEREBY RESOLVED: 1. The Town Council hereby finds that during the course of the hearing on this appeal that the Town's traffic policies have been amended and that the proposed subdivision may be approvable under the revised policies. The revised policies regulating residential development with unmitigated traffic impacts provide that the Planning Commission make findings to allow a lot split creating a corridor lot and this appeal should be determined by the Planning Commission based on said policies. 2. The Town Council further finds that the application must be reviewed by the Development Review Committee for the recommendation of conditions for subdivision approval and findings of consistency with the new traffic policy. 3. Based on the foregoing, the Town Council hereby remands the appeal of the subdivision application to the Planning Commission to consider the following: 1. Whether this application meets the criteria for subdivision under the revised Town traffic policies; 2. If a subdivision can be approved on the property, whether findings can be made to permit the lot split creating a corridor lot which show that the corridor lot is the superior design by reducing the amount of grading and /or the amount of vegetation to be removed; and 3• If subdivision approval is possible, to make conditions of approval. -2- PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 4 day of Janua 1988 by the following vote.
