RESOLUTION REMANDING TO PLANNING COMMISSION APPEAL OF
PLANNING COMMISSION'S APPROVAL OF PLANS TO REMODEL AND
CONSTRUCT A SECOND STORY TO AN EXISTING SINGLE FAMILY
RESIDENCE IN THE R- lD -LHP ZONE
(219 MASSOL AVENUE - JACK & JANET COOK)
WHEREAS:
1. James McManis has appealed a decision of the Planning
Commission as follows: Approval of plans to remodel and construct a
second story to an existing single family residence in the R- lD -LHP zone
on property located at 219 Massol Avenue and owned by Jack and Janet Cook
(Architecture and Site Application 5- 87 -23); and
2. A public hearing was held by the Town Council on September 8,
1987, on September 21, 1987, continued to October 19, 1987, continued to
and held on November 16, 1987 and on December 7, 1987.
BE IT RESOLVED:
1. The Town Council hereby finds that the Planning Commission
erred in not properly considering the mass and the height of the building.
2. Based on the foregoing findings, the Town Council hereby
remands the matter to the Planning Commission for consideration by the
Development Review Committee (DRC) in accordance with the following:
a. Consideration of the height and mass of the building;
b. The affected neighbors be sent notice of the DRC meeting
and their right to be present; and
C. Address the safety concerns set forth in the letter from
engineer Roger F. Reedy.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 21 day of December
1987 by the following vote.
