1987-203-Denial Of The Demolition Of An Existing Single Family Residence And The Construction Of An Office Building In The Office ZoneRESOLUTION NO: 1987 -203 RESOLUTION REMANDING APPEAL OF PLANNING COMMISSION DENIAL OF THE DEMOLITION OF AN EXISTING SINGLE FAMILY RESIDENCE AND THE CONSTRUCTION OF AN OFFICE BUILDING IN THE 0 (OFFICE) ZONE (404 UNIVERSITY AVENUE - J & P SCOTT, INC.) WHEREAS: 1. Paul 0. Lamphere, counsel on behalf of J & P Scott, Inc., has appealed a decision of the Planning Commission as follows: Denial of Architecture and Site Application S -86 -50 requesting demolition of an existing single family residence and the construction of an office building in the 0 (Office) Zone on property located at 404 University Avenue and owned by J & P Scott, Inc.; and 2. A public hearing was set before the Town Council for August 17, 1987 and continued at the property owner's request to September 8, 1987 and to November 16, 1987 on which date the public hearing was held by the Town Council. IT IS HEREBY RESOLVED: 1. The Town Council hereby finds that the Planning Commission did not consider all aspects of the application. 2. The Town Council hereby further finds that the applicant requested the appeal be remanded to the Planning Commission. 3. Based on the foregoing findings, the appeal is hereby remanded to the Planning Commission for consideration of the following and to make findings thereon: a. size of lot with comparison to size of the building; b. conversion of residential use; C. traffic; d. access to the property from Saratoga Avenue; and e. design of parking facility is not satisfactory. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 21 day of December 1987 by the following vote.
