RESOLUTION REMANDING TO PLANNING COMMISSION THE APPEAL
OF PLANNING COMMISSION APPROVAL OF PLANS FOR CONSTRUCTION
OF MULTI- PURPOSE BUILDING (GYMWASIUM /CLASSROOMS)
(16000 MARCHHOWT DRIVE - HILLBROOK SCHOOL)
WHEREAS:
1. Jeffrey A. Barnett, individually and on behalf of the Ann Arbor -
Nollin Homeowners Association, Hugh T. Thompson, individually and on behalf of
the Ann Arbor - 4lollin Homeowners Association, and Diane E. Hembry have
appealed a decision of the Planning Commission as follows: approval of plans
for the construction of a multi - purpose building (gyranasiun /classrooms) on
property in the HR -1 Zone located at 16000 Marchmont Drive and owned by
Hillbrook School (conditional use permit application U- 80 -10B, Architecture and
Site Application S -80 -238 and recommended negative declaration).
2. A public hearing was held by the Town Council on November 2, 1987.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission erred
because it did not consider the need for additional parking due to special
events due to lack of information presented to the Commission.
2. The Town Council further finds that the proposed use is
appropriate.
3. Based on the foregoing finding the matter is remanded to the
Planning Commission for consideration of the following:
as additional parking;
b. mitigation measures for noise and visual impact, and
C. investigation of other sites, if the Planning Commission so
chooses.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 16 day of November
1987 by the following vote.
AYES: COUNCIL MEMBERS Thomas J. Ferrito, Robert L. Hamilton .
and Vice -Mayor Eric D. Carlson
NOES: COUNCIL MEMBERS None
ABSTAIN: COUNCIL MEMBERS Joanne Benjamin
