1987-193-Approval Of Plans For Construction Of Single Family Residence In The R-1:20,000 ZoneRESOLUTION NO: 1987 -193 RESOLUTION GRANTING APPEAL OF PLANNING COHMISSION APPROVAL OF PLANS FOR CONSTRUCTION OF SINGLE FAMILY RESIDENCE IN THE R- 1:20,000 ZONE (17121 LOS ROBLES CLAY - RICHARD N. SALICE) WHEREAS: A. Beverly Hays has appealed a decision of the Planning Commission as follows: approval of Architecture and Site Application S -87 -38 requesting approval of plans for construction of a single family residence in the R- 1:20,000 Zone on property located at 17121 Los Robles May and owned by Richard N. Salice; and B. A public hearing was held by the Town Council on Noveriber 2, 1987. IT IS HEREBY RESOLVED: A. The Town Council finds that the Planning Commission erred'in not fully exploring the need for a slightly increased road in the area because the appellant did not appear before them. B. Based on the foregoing finding, the appeal is hereby granted and Architecture and Site Application S -87 -38 is granted subject to the following conditions: 1. Final grading, drainag¢, masonry retaining wall, driveway, utility, interim and final erosion control plans shall be provided, to the satisfaction of the Town Engineer. 2. No grading or earth disturbing activities shall be initiated between October 1 to April 15. For grading operations commenced prior to October 1, all grading or earth disturbing activities shall cease October 15 and will not be allowed to restart until April 15. These limitations apply to the following: driveways, building pads, foundation trenches and drilled piers, retaining walls swimming pools, tennis courts, outbuildings, and utility trenches. If final landscaping is not complete by September 1, interim erosion control measures shown on the approval interim erosion control plan will be required to be instituted by October 1 and maintained throughout the October 1 to April 15 period, to the satisfaction of the Town Engineer. 3. Any work in the public right -of -away will require an Encroachment Permit, to the satisfaction of the Town Engineer. 4. A well information questionnaire (available through the Town Engineer) shall be completed to the satisfaction of the Town Engineer. 5. A two year Tree /Landscape Maintenance Agreement shall be entered into, to the satisfaction of the Director of parks, Forestry and Maintenance Services and the Town Engineer. 6. Additional paving shall be added to Los Robles Clay to widen it on the northerly side to the satisfaction of the Town Engineer, PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 16 day of November 1987 by the following vote.
