RESOLUTION DENYING APPEAL OF PLANNING COMISSION APPROVAL
OF PLANS FOR CONSTRUCTI0N OF AN OFFICE BUILDING IN THE
"0" ZONE SUBJECT TO VARIOUS CONDITIONS
(14901 NATIONAL AVENUE - WEST VALLEY ASSOCIATES)
WHEREAS:
A. Catherine Smith has appealed a decision of the Planning
Commission as follows: Approval of plans for construction of an office
building in the "0" Zone subject to various conditions on property located
at 14901 National Avenue and owned by West Valley Associates (Architecture
and Site Application 5- 84 -9 -A); and
B. A public hearing was held by the Town Council on September 21,
1987.
IT IS HEREBY RESOLVED:
A. The Town Council hereby finds that no testimony or evidence was
presented that the Planning Commission decision was in error.
D. The Town Council hereby further finds that the project is
consistent with other buildings in the area.
C. Based on the foregoing findings, appeal is denied and
Architecture and Site approval is granted subject to the following
conditions:
1. Enter into an agreement and post a bond satisfactory to the
Town Council, agreeing to pay for 10% of the cost ($9,000) of the
future traffic signal at the intersection of National Avenue and
Los Gatos - Almaden Road, to the satisfaction of the Town Engineer.
2. Payment of a 1% in-lieu fee (totaling $2,150.00) for
proposed traffic signal and intersection improvements at Los
Gatos Boulevard and Blossom Hill Road, to the satisfaction of the
Town Engineer.
3. Submit final grading, drainage, parking lot, driveway,
driveway ramp profile, lighting plans, to the satisfaction of the
Town Engineer.
4. Curb, gutter and sidewalk, driveway, utility services, and
tie -in paving improvements on National Avenue shall be guaranteed
by contract, Faithful Performance Bond, Labor & hlaterialman's
Bond, insurance, and completed prior to the occupancy of any new
building, to the satisfaction of the Town Engineer.
5. All documents, contracts, surety, insurance, as applicable,
shall be provided prior to recordation of any final map or
issuance of any pernits, to the satisfaction of the Town
Engineer.
5. The off - hauling of the excess excavated material shall be
limited to the period between 9:00 a.m. and 3:00 p.m., Monday
through Friday.
7. A soils and geologic report shall be prepared which provides
specific criteria and standards governing site grading, drainage,
foundation design and erosion control, to the satisfaction of the

Town Engineer. A registered civil engineer, specializing in soil
mechanics, should be included in the group that prepares this
report.
8. A Grading Permit and surety (bonds, letter of credit or
cash) shall be required for all excavation, the placement of all
fill and retaining walls to the satisfaction of the Town
Engineer.
9. All grading operations shall be continuously inspected by
the soils engineer or his qualified representative and these
inspections should be coordinated with regular Torun inspections.
The soils engineer shall prepare a final grading report, to the
satisfaction of the Town Engineer.
10. Surety (bonds, letter of credit or cash) shall be required,
in an amount to be determined, to insure the restoration of
street pavement and associated public improvements in the event
of damage by the dump truck traffic, to the satisfaction of the
Town Engineer.
Upon completion of the grading and hauling operations, the
contractor shall clean the portion of National Avenue, designated
as dump truck route, to the satisfaction of the Town Engineer.
12. A key lockbox shall be provided on the exterior of the
building adjacent to the main entrance to tine satisfaction of
Central Fire Protection District.

13. The building shall be fire sprinklered and the roof covering
shall be fire retardant.
14. A two -year tree maintenance contract shall be established
for the protection of existing and newly planted trees, to the
satisfaction of the Town Engineer.
15. Prior to any building permits being issued, the applicant
shall meet with the Director of Parks, Forestry and Maintenance
Services concerning the need for protective fencing around the
existing trees. A plan for such protective fencing demonstrating
type and location shall be submitted to the Planning Director
after being approved by the Director of Parks, Forestry and
Maintenance Services. Such fencing is to be installed prior to,
and be maintained during construction.
16. Change the plant species for the balcony planters and the
screen planting to include taller and more dense trees to the
satisfaction of the Director of Parks, Forestry and Maintenance
Services.
17. Substitute redwoods for all the trees proposed on the
required front yard to the satisfaction of the Director of Parks,
Forestry and Maintenance Services.
Pursuant to Los Gatos Town Code Section 1 -15, the tine for seeking
judicial review for the Town Council decision is governed by California
Code of Civil Procedure Section 1094.6.

Town of Los Gatos, California, held on the 16 day of November
1987 by the following vote.
