1987-144-Denial Of Zone Change Application Requesting Change In ZoneRESOLUTION NO: 1987 -144 RESOLUTION REMANDING TO PLANNING COMMISSION THE APPEAL OF PLANNING COMMISSION DENIAL OF ZONE CHANGE APPLICATION REQUESTING CHANGE IN ZONE FROM 0, R- 1:8,000 AND RH:5 -20 to RN:5 -20 -PD TO CONSTRUCT A 72 UNIT RESIDENTIAL DEVELOPMENT ON 10.2 ACRES OF PROPERTY AT THE SOUTHEAST CORNER OF BLOSSOM HILL ROAD AND ROBERTS ROAD AND DENIAL OF REQUEST FOR CERTIFICATION OF DRAFT ENVIRONMENTAL IMPACT REPORT (300 BLOSSOM HILL ROAD - VASONA HILLS PARTNERSHIP) WHEREAS: 1. Que Naderzad, on behalf of Vasona Hills Partnership, has appealed a decision of the Planning Commission as follows: denial of Zone Change Application Z -86 -6 requesting change in zone from 0, R- 1:8,000 and RM:5 -20 to RM:5 -20 -PD to construct a 72 unit residential development on 10.2 acres of property at the southeast corner of Blossom Hill Road and Roberts Road and denial of request for certification of Draft Environment Impact Report EIR -85 -1A on property located at 300 Blossom Hill Road and owned by Ed Nino and Vasona Hills Partnership; 2. A public hearing was held by the Town Council on July 20, 1987. On August 3, 1987, the Town Council decided to reconsider the matter and set the hearing for September 8, 1987. A public hearing was held by the Town Council on September 8, 1987. BE IT RESOLVED: 1. The Town Council hereby finds that the applicant presented a new plan for thirty -two (32) single family units which has not been reviewed by the Planning Commission and that this application should be remanded to the Planning Commission with review by the Development Review Committee. 2. Based on the foregoing, the appeal is hereby remanded to the Planning Commission with review by the Development Review Committee for the preparation of a Planned Development ordinance in accordance with the following direction: a. The application should be expedited; b. The entrance to Vasona Park shall be redone to align with Roberts Road and be signalized and the expense shall be borne by the developer; c. Any requirements for any contribution to the Highway 17 /Blossom Hill Road overcrossing and the Roberts Road bridge improvement shall be deleted; d. The amount of traffic generated by thirty -two (32) single family units and the requisite Below Market Price (BMP) units appears to be acceptable; e. The Roberts Road bridge, the Wino house and the rock wall shall be preserved; f. The development of the paths and trails shall be extended along Los Gatos Creek; g. Grading shall be minimized; and h. The visual impact of the project on Vasona Park shall be minimized. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 21 day of September 1987 by the following vote.
