RESOLUTION REMANDING TO PLANNING COMMISSION THE
APPEAL OF PLANNING CONHISSION DENIAL OF REQUEST
TO OPERATE A SUPER DRUGSTORE WITHIN THE EXISTING
NOB HILL SHOPPING CENTER AND TO MAKE EXTERIOR
MODIFICATION TO EXISTING CENTER ON PROPERTY IN
THE C -1 ZONE
(15698 LOS GATOS BOULEVARD - LOtV S DRUG STORES CALIFORNIA, INC.)
WHEREAS:
i. Gary Veasy, on behalf of Applicant Long's Drug Stores
California, Inc., has appealed a decision of the Planning Commission as
follows: denial of request to operate a super drugstore within the
existing Nob Hill Shopping Center and to crake exterior modifications to
the existing property in the C -1 zone (Conditional Use Permit Application
U -86 -196 and Architecture and Site Application S- 86 -57) for property
located at 15698 Los Gatos Boulevard and owned by Steve Musich;
2. A public hearing was scheduled for May 18, 1987, continued to
June 1, 1987, June 15, 1987, and July 6, 1987 on which date a public
hearing was held by the Town Council.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the footnote on page 16 of
the Initial Study prepared by Mindigo and Associates is incomplete and is
necessary for Council determination of whether a negative declaration for
the project can be made.
2. The Town Council further finds that the applicant could reduce
the traffic generation by considering alternatives such as not selling
alcoholic beverages and lianiting the number of check -outs.

3. The Town Council further finds that the proposal shall meet
all handicapped accessibility standards.
4. Based on the foregoing, Town Council hereby remands the appeal
to the Planning Commission to consider the complete report on the initial
study, whether a negative declaration for the project can be made, and
review applicant's decisions on changes it could make to the application
to reduce traffic impacts of the project.
PASSED AND ADOPTED at a. regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 8th day of
September 11987 by the following vote.

and Robert L. Hamilton
