RESOLUTION GRANTING APPEAL OF
PLANNING COMMISSION APPROVAL
OF TWO (2) LOT SUBDIVISION OF
PROPERTY IN R- 1:8000 ZONE
(16768 FRANK AVENUE - MAHMOUD OVEYSSI)
WHEREAS:
1. John Uhl filed an appeal of a decision of the Planning Commission as
follows: Approval of subdivision application 0486 -5 requesting a two (2)
lot subdivision of property in the R- 1:8000 zone on property located at
16768 Frank Avenue and owned by Mahmoud Oveyssi (Agent - Polyplan Inc.);
2. A public hearing was held by the Town Council on August 3, 1987.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission erred in
failing to consider the linking of the intersections of Lark and Los Gatos
Boulevard and of Lark Avenue and Highway 17 regarding peak hour traffic
and the level of service of those intersections if considered together.
2. The Town Council further finds that the Planning Commission erred in
failing to consider that an existing house is to be moved to create the
lot split.
3. The Town Council further finds that the appeal should be remanded to
the Planning Commission for consideration of the following:
a. Calculation of the amount of peak hour trips to be generated
in considering the two (2) intersections together;
b. Whether an in -lieu fee is appropriate and, if so, the amount
thereof; and
C. Recommendation regarding the necessity of razing or relocating
an existing house in order to allow a lot split.
4. Based on the foregoing, the appeal is hereby granted and
remanded to the Planning Commission for consideration in accordance with
the directions of paragraph three above.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 17th day of August
1987 by the following vote.
