A RESOLUTION APPROVING THE ANNEXATION
OF CERTAIN UNINHABITED TERRITORY
DESIGNATED AS NOVITIATE #2
TO THE T014N OF LOS GATOS
WHEREAS, on June 10, 1987, the Local Agency Eormation Commission of the County of
Santa Clara, State of California, pursuant to a petition signed by all the owners of
land within the territory to be annexed, approved the annexation of that hereinafter
described area, designated as Novitiate #2 to the Town of Los Gatos and, by their
Resolution No. 87 -09, directed the Town Council of the Town of Los Gatos to initiate
proceedings to annex said territory without notice, hearing, or election, in the
manner described in the section of the Government Code of the State of California,
and made the following findings:
1. The project is categorically exempt from CEQA Class #15119(a).
2. The territory is "Uninhabited" as defined in Section 56046 of the
Government Code of the State of California; and
WHEREAS, the Town Council finds that the findings of the Local Agency Formation
Commission in Resolution 87 -09 are correct, and the territory proposed for
annexation is situated in the unincorporated area of the County of Santa Clara, and
is contiguous with the municipal boundaries of the Town of Los Gatos.
RESOLVED, by the Town Council of the town of Los Gatos, a municipal corporation of
the County of Santa Clara, State of California, that pursuant to the provisions of
Sections 56837, 57022, and 57002 of the Government Code of the State of California,
the annexation to the Town of Los Gatos of that territory designated as Novitiate
#2, and described in real property description attached hereto, marked Exhibit "A"
and shown on area map marked Exhibit "B" is approved, and that the same be annexed
to the Town of Los Gatos.
FINALLY RESOLVED, that the Town Clerk is authorized, and is hereby directed,
pursuant to Section 57200 of the Government Code; to prepare under seal a certified
copy of this resolution, giving the date of passage, and immediately transmit same
along with a remittance to cover the fees required by Section 54902.5 of the
Government Code to the Executive Officer of the Local Agency Formation Commission of
Santa Clara County.
