1987-066-Denying Architecture And Site Approval To Demolish Burned-Out Restaurant Building, Construct New 2-Story Office Building And Combine The Property On Los Gatos Boulevard In The C-1 ZoneRESOLUTION NO: 1987 -66 RESOLUTION REMANDING —TO THE— PLANNING COMMISSION DECISION OF PLANNING COMMISSION DENYING ARCHITECTURE AND SITE APPROVAL TO DEMOLISH BURNED -OUT RESTAURANT BUILDING, CONSTRUCT NEW 2 -STORY OFFICE BUILDING AND COMBINE THE PROPERTY WITH ADJACENT PROPERTY ON LOS GATOS BOULEVARD IN THE C -1 ZONE (16275 Los Gatos Boulevard - Leroy Neider) WHEREAS: 1. Leroy Neider has appealed a decision of the Planning Commission as follows: denial of Architecture and Site Application (S -87 -5) request to demolish burned -out restaurant building, construct a new 2- story, 5,120 sq.ft. office building, and to combine the property with an adjacent property fronting on Los Gatos Boulevard in the C -1 zone for property located at 16275 Los Gatos Boulevard and owned by Leroy Neider; and, 2. A public hearing was held by the Town Council on May 18, 1987. IT IS HEREBY RESOLVED: A. The Town Council hereby finds that the Planning Commission decision was in error in consideration of the applicant's willingness to reduce the size of the project. B. The Town Council further finds that office use is appropriate if the scale and mass are reduced. C. Based on the foregoing findings, the appeal is hereby remanded to the Planning Commission with review by the Development Review Committee to consider a project reduced in scale and mass.
