RESOLUTION REMANDING TO THE PLANNING
COMMISSION DECISION OF PLANNING
COMMISSION DENYING APPROVAL OF PLANS FOR
CONSTRUCTION OF MINI - WAREHOUSE STORAGE
FACILITY AND FOR PERMISSION TO HAVE
SINGLE FAMILY RESIDENCE FOR USE BY
RESIDENT MANAGER FOR PROPERTY IN THE LM
ZONE.

WHEREAS:
1. John M. Knott, on behalf of Public Storage, Inc., has appealed
a decision of the Planning Commission as follows: denial of Architecture
and Site Application S -78 -7A requesting approval of plans for the
construction of a mini - warehouse storage facility and denial of
Conditional Use Application U -78 -3A for permission to have a single family
residence for use by a resident manager for property in the LM Zone
located at 761 University Avenue owned by Jon P. Anderson and agent Public
Storage, Inc.; and,
2. A public hearing was held by the Town Council on May 4, 1987.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission
decision was in error concerning the impacts of grading off -haul because
the applicant presented new information to the Town Council that the
impact of off - hauling earth material for several days would be less than
the current truck use to and from the site.
2. The Town Council further finds that the use of the property is
appropriate for the zone.
3. The Town Council further finds that the scale of the
development should be reduced by at least one -third but that two - thirds is
not required.
4. Based on the foregoing findings, the appeal is hereby remanded
to the Planning Commission with review by the Development Review Committee
for consideration of the reduced project.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review for the Town Council decision is governed by California
Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of
the Town of Los Gatos, California, held on the may_ day
of May 11987 by the following vote.
