RESOLUTION GRANTING APPEAL OF
DECISION! OF PLANNING COMMISSION
DENYING APPLICATION FOR SECONDARY
DWELLING UNIT ON PROPERTY LOCATED
IN THE R -10-LHP ZONE
(216 Glen Ridge Ave, - James McMannis)
WHEREAS:
1, James McManis has appealed a decision of the Planning Commission denying
Secondary Dwelling Unit Application D -85 -156 for a secondary dwelling unit on
property located in the R -1L' -LHP Zone at 216 Glen Ridge Avenue;
2. A public hearing was field by the Town Council on May 19, 1986 and August 4,
1986,
IT IS HEREBY RESOLVED:
1, The Town Council hereby finds that a secondary dwelling unit (as defined in
Zoning Ordinance Section 2,00.417) existed on the property on June 1, 1983,
2, The Town Council further finds that the Planning Commission erred in not
considering the intent of the Secondary Dwelling Unit Ordinance to grandfather
safe, habitable secondary dwelling units.
3. Based on the foregoing findings, the Town Council hereby grants the
secondary dwelling unit application on the condition that all Zoning Ordinance
requirements, including the installation of a kitchen, and Town Housing Code
requirements be completed within one (1) year from the adoption of this
resolution,
4, If the work as specified above is not completed within one (1) year period,
the secondary dwelling unit permit may not issue.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial
review for the Town Council decision is governed by California Code of Civil
Procedure Section 109496,
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos, California, held on the 6th day of April, 1987, by the following
vote:
