1987-037-Use Permit For Permission To Construct A Guest Cottage Without Kitchen On Property In The R-1D-LHP ZoneRESOLUTION NO: 1987 -37 RESOLUTION DENYING APPEAL FROM PLANNING COMMISSION DENIAL OF CONDITIONAL USE PERMIT FOR PERMISSION TO CONSTRUCT A GUEST COTTAGE WITHOUT KITCHEN ON PROPERTY IN THE R -1D- LHP 7.ONE (121 WILDER AVENUE - EMILY L. BROWN) WHEREAS: 1, Minty Brown appealed a decision of the Planning Commission as follows: denial of Conditional Use Permit Application U -85 -33 requesting permission to construct a guest cottage (without kitchen) on property located in the R -1D -LHP zone at 121 Wilder Avenue and owned by Emily L. Brogan; 2. A public hearing was set before the Town Council for January 5, 1987 at which time the Council continued the matter to March 16, 1987 to permit the appellant to refile plans with the Development Review Committee and for a rehearing before the Planning Commission, Specific dates for performance were set by the Council. No revised plans were filed and no hearings were scheduled; 3. A public hearing was held by the Town Council on March 16, 1987, IT IS HEREBY RESOLVED: 1. The Town Council hereby finds that no testimony was presented that the Planning Commission decision was in error. 2. Based on the foregoing finding, the appeal is denied. Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review for the Town Council decision is governed by California Code of Civil Procedure Section 1094.6. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town, of Los Gatos, California, held on the 6th day of April 1987 by the following vote. AYES: COUNCIL MEMBERS Eric D.
