1987-033-Establishing A Policy To Encourage The Use Of The Planned Development Process To Assure Compatibility Of In-Fill Projects With Their EnvironsRESOLUTION NO. 1987 -33 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ESTABLISHING A POLICY TO ENCOURAGE THE USE OF THE PLANNED DEVELOPMENT PROCESS TO ASSURE COMPATIBILITY OF IN -FILL PROJECTS WITH THEIR ENVIRONS WHEREAS, the Town has increasingly been concerned with preserving and protecting its residential neighborhoods from developments that might reduce the desirability of those neighborhoods; and WHEREAS, increasing land prices and building values have been shown in some cases to influence developments that may not be in character with those existing residential neighborhoods in proximity to the few remaining in -fill areas of the Town; and WHEREAS, many of these in -fill properties are of a size, location or physical configuration that prohibit or make extremely difficult a development of lot size and configuration totally compatible with the existing residential neighborhoods, THEREFORE, be it resolved the Council does establish the following policy concerning use of the Planned Development process in such cases: 1. Section 4.82.020 of the Zoning Ordinance states the purpose of the Planned Development Overlay Zone as follows: The purpose of the PD zone is to provide for alternative uses and developments more consistent with site characteristics than are allowed in other zones, and so create an optimum quantity and use of open space and encourage good design. The PD zone permits establishment of a single use or the integration of several uses not ordinarily permitted by the regulations of any other zone. Such flexibility is possible only if use and development is in compliance with a complete development plan ;showing relationships of the use or uses to each other, to the district as a whole, and to surround areas. 2. The Planned Development process is an overlay zone available for use on parcels of land 40,000 square feet or larger. The RD process can be used to provide compatibility of design, building density and development standards with the adjacent neighborhood. The PD process should be used on larger infill parcels whose terrain, existing vegetation or property configuration will not permit compatible development if processed using standard zoning requirements. 3. The Planned Development process shall not be used to increase the density of development from that of the adjacent neighborhood, nor to develop building types or styles that would be architecturally incompatible. 4. The Planned Development process benefits the Town and the neighborhood by allowing a project to be reviewed in such detail at the earliest possible stage to avoid impacts on adjacent properties through proper design. 5. An approved PD limits the ability of the property owner /developer to change any part of the project without public review.
