RESOLUTION GRANTING APPEAL FROM DECISION OF THE BUILDING OFFICIAL
CONCERNING HANDICAPPED ACCESS REQUIREMENTS

WHEREAS: has appealed a

decision of the Building Official as follows: requiring modifications to
sanitary facilities and to front entry to meet handicapped accessibility
regulations for the proposed remodel of a retail store at 6 North Santa Cruz
Avenue;

October 65 1986 the appellant and the Building Official determined that the
modifications to the sanitary facilities could be made to meet handicapped
accessibility regulations.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that an unreasonable hardship exists
requiring a level landing at the front door and that equivalent facilitation is
provided by the installation of an automatic door - opening device based on the
following:
a. The total area of space for the store is 1000 square feet;
b. The cost to modify the building entrance s estimated to be
$7000 - $10,000 while the total construction cost is approximately
$20,000; and
c. Equivalent facilitation for entry to the store is provided by the
use of an automatic door - opener in lieu of providing a level
landing.
2. Based on the foregoing findings, the appeal is granted as follows:
a. An automatic door - opener shall be installed at the front door to
provide for handicapped access to the store.
b. The sanitary facilities serving the remodeled store shall comply
with the handicapped accessibility regulations of Title 24 of the
California Administration Code.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review for the Town Council decision is governed by California Code of
Civil Procedure Section 1094.6.
