A RESOLUTION OF INTENTION TO VACATE A 30 FOOT WIDE STRIP OF LAND
LOCATED AT 800 FOSTER ROAD (BARTLETT) APN: 537 -03 -043
FOR STREET PURPOSES
RESOLVED:
1. It is the intention of the Town Council to vacate, under the provisions of
Division 9, Part 3 (Sections 8300 through 8331) of the Streets and Highways Code, a
30 foot side strip of land situated in the Town of Los Gatos, County of Santa Clara,
State of California, consisting of a strip of land approximately 231 feet long
containing approximately 6,940 square feet located across property located at Foster
Road, and more particularly described in Exhibit "A" (Description of Public
Right -of -Way to be Abandoned [800 Foster Road; Bartlett - APN: 537 -03 -0431 by the
Town of Los Gatos), and Exhibit "B" (Plat to Accompany Description of Public
Right -of -Way Abandonment), copies of which are attached hereto. Said Exhibits show
the particulars as to the proposed abandonment, and are available for public
inspection in the Office of the Town Clerk of the Town of Los Gatos, Civic Center,
110 East Main Street, Los Gatos, California.
2. On November 17, 1986, in the Council Chambers of the Civic Center, 110 East
Main Street, Los Gatos, California, the Town Council will hold a public hearing to
consider whether or not the easement is necessary for present or prospective public
use. The meeting will begin at 7:30 P.M. All persons interested are invited to
attend and be heard.
3. The Town Clerk is authorized, and is hereby directed to publish a copy of
this resolution in a newspaper of general circulation, published and circulated in
the Town of Los Gatos, within fifteen (15) days after the date of its adoption.
4. The Mayor of the Town of Los Gatos is authorized, and is hereby directed to
execute that document entitled, "Notice of Abandonment of A 30 Foot Wide Strip of
Land Located at 800 Foster Road (Bartlett) - APN: 537 -03- 043 ", a copy of which is
attached hereto, and the Town Engineer is authorized, and is hereby directed to
conspicuously post three (3) copies of said Notice, not more than 300 feet apart, on
at least ten (10) days before the date of the public hearing above designated.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos held on the —6th day of October 1986 by the following vote:

DESCRIPTION OF A 30 -FOOT -WIDE RIGHT -OF -WAY STRIP
All that property situate in the Town of Los Gatos, County of Santa Clara,
State of California, being more particularly described as follows:
A strip of land 30.00 feet wide the Northerly line of which is more
particularly described as follows: Beginning at the most Northerly
corner of that certain parcel one as conveyed to V J. Tidball by deed,
recorded in Book 6810, Official Records, Page 339, Santa Clara County
Records, said point lying in the center of a ravine, and from point, a
Laurel tree eight inches in diameter stands South 45° West 6.27 feet
and a laurel six inches in diameter stands South 71° 50' West at 7.26
feet; thence running upstream South 38° 05' East 100.32 feet to the
most northerly corner of the 2.92 acre tract described in the deed
from B. F. Garrison to Rowena P. Watters, dated February 28, 1898 and
recorded in Book 209 of Deeds, Page 123, Santa Clara County Records,
from which a redwood post bears South 42° 52' West six feet and from
which a witness post a Live Oak tree six inches in diameter bears
North 700 30' West 11.22 feet distant; thence up the center of said
creek or ravine with the following courses and distances: South 360
45' East 25.41 feet, South 590 East 23.76 feet, South 39•0 East 18.438
feet, South 37° East 19.14 feet, South 58° 57' East 14.52 feet, South
30° 57' East 15.18 feet, and South 49° 51' East 14.50 feet to the
terminus of the 30 foot strip herein described.

NOTICE IS HEREBY GIVEN that on October 6, 1986, the Town Council of the
Town of Los Gatos, County of Santa Clara, State of California, adopted
Resolution No. 1986 -161 entitled, "A RESOLUTION OF INTENTION TO VACATE A 30
FOOT WIDE STRIP OF LAND LOCATED AT 800 FOSTER ROAD (BARTLETT) - APN:
537 -03 -043 FOR STREET PURPOSES ", located across the above mentioned property. A
copy of said Resolution No. 1986 -161, and a map entitled, "PLAT TO ACCOMPANY
DESCRIPTION OF PUBLIC RIGHT -OF -WAY ABANDONMENT ", showing the particulars as to
the proposed vacation are on file in the Office of the Town Clerk of the Town
of Los Gatos, Civic Center, 110 East Main Street, Los Gatos, California, and
are available for inspection during regular business hours.
