RESOLUTION REMANDING TO THE PLANNING COMMISSION DECISION OF
PLANNING COMMISSION DENYING CONDITIONAL USE PERflIT APPLICATION ADD
ARCHITECTURE AND SITE APPLICATION REQUESTING APPROVAL TO OPERATE AM
AUTO REPAIR SERVICE AND TO CONSTRUCT A BUILDING ON PROPERTY LOCATED
IN THE LM ZONE
(644 University Avenue - A. Dimitropoulos)
WHEREAS:
A. Applicant Angelo Dimitropoulos has appealed a decision of the
Planning Commission as follows: denial of Conditional Use Permit Application
U-85-916 and Architecture and Site Application S-85-64 requesting approval to
operate an auto repair service and to construct a building on property in the
L114 zone located at 644 University Avenue and owned by AD & Associates; and
B. A public hearing was held by the Town Council on September 2, 1986;
IT IS HEREBY RESOLVED:
A. The Town Council finds that the Planning Commission erred in not
-considering the following:
1. The exact traffic generation of the proposed project; and
2. The policy of the Downtown Specific Plan to locate local
serving businesses in the Downtown Service Commericial area. (II
Land Use, Implementation B.2. - page 11-5).
B. The Town Council further finds that traffic counts are necessary to
determine whether the traffic generation from the proposed project is less than
or equal to the current use.
C. The Town Council further finds that the automobile repair business
operated by the applicant is specialized in nature and is therefore less
intensive than other automobile repair businesses.

D. Based on the foregoing findings, the appeal is hereby remanded to the
Planning Commission with review by the Development Review Committee for
consideration of the following:
1. Traffic generation figures based on traffic counts of the
current uses on the property at 644 University Avenue and actual
traffic counts of the applicant's business at its current location.
2. Compliance with the plant resources provisions on the General
Plan Conservation and Historic Preservation Element 8.4 Policies
4f. to maintain specimen trees to keep tree removal to a minimum.
3. Consider limiting the permit to specialty automotive repair and
determining the parameters of such approval:
4. Delineation of a system to monitor compliance with any
conditions relating to the limitations that would be set by item 3
above (including but not limited to number of employees, hours of
operations, number of vehicles accepted for service, etc.

Town of Los Gatos, California, held on the 15th day of September , 1986..
by the following vote.
