RESOLUTION SUPPORTING SANTA CLARA VALLEY WATER
DISTRICT'S SUPERVISION OF UNDERGROUND STORAGE TANK CLEANUP
WHEREAS, this Council recognizes the existence of a serious threat to
the groundwater resources of the County and of this Town and
its inhabitants by reason of fuel leaks from storage tanks
into the underlying soils and in this manner threatening to
contaminate and degrade the aquifers which provide domestic
water; and
WHEREAS, this Council is advised and finds that some four hundred
leaking fuel sites are suspected to exist in Santa Clara
County and that the number is expected to rise to seven hundred
upon closer investigation; and this Council is further advised
that the San Francisco Regional Water Quality Control Board
has been unable to secure an allocation of manpower to
supervise its cleanup orders and sees no prospect of such an
allocation; and
WHEREAS, this Council finds that the Santa Clara Valley Water District
is the local public agency best equipped by reason of county-
wide jurisdiction, experience and hydrogeologic expertise to
supervise cleanup of such spills as they are discovered.
BE IT RESOLVED, the Town Council of the Town of Los Gatos, County of
Santa Clara, State of California, that this Council hereby
requests Santa Clara Valley Water District to accept the task
of overseeing cleanup of fuel leaks within and without the
Town.
That the Council fully understand
District lacks legal authority to
to dischargers and that therefore
to be done and should properly be
with the cognizant Regional Water
Board; and
that the said
issue cleanup orders
the work will have
done in cooperation
Quality Control
2. That the Council further recognizes that the task is
beyond the present fiscal resources of the District
and that funding must be sought and applied; in which
endeavors the District is encouraged to make every
possible effort and that in that effort this Town
Will cooperate fully.

California, at a regular meeting held on the 19th day of Play, 1986,
by the following vote:
