RESOLUTION REMANDING TO THE PLANNING COMMISSION
THE APPEAL OF A DECISION OF THE PLANNING COMMISSION
IN DENYING THE REQUEST TO DEMOLISH AN EXISTING
RESIDENCE AND TO CONSTRUCT A NEW SINGLE FAMILY
RESIDENCE IN THE R- 1D:LHP ZONE
(229 Bachman Avenue -- Wells L. Marvin)
WHEREAS:
1. Wells L. Marvin has appealed a decision of the Planning Commission
as follows: denial of request to demolish an existing residence to
construct a new single family residence in the R- 1D:LHP xone on property
located at 229 Bachman Avenue;
2. A public hearing was held by the Council on April 7, 1986.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission erred
concerning the request for demolition in not considering the present
condition of the house and the deficiencies listed in the property
inspection report.
2. The Town Council further finds that the Planning Commission erred
concerning construction of a new residence in not considering the
positive impact onthe neighborhood in locating a residential anchor
to clearly establish the area as residential and not commercial.
3. The Town Council further finds that since the Historic Preservation
Committee finds the existing house is of no historic merit or architectu-
rally significant, demolition of the structure would not be detracting
to the neighborhood.
4. The Town Council further finds that this matter should be referred
to the Planning Commission for consideration of a smaller scale house
than the present proposal to replace the existing structure.
5. Based on the foregoing findings, demolition of the existing
structure at 229 Bachman Avenue is permitted subject to an approved
plan for a replacement structure and the appeal is remanded to the
Planning Commission with review by the Development Review Committee
for consideration of a replpceraeat structure on a smaller scale than
the present proposal.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos held on tHe 27 day of April 1986 by
the following vote:
