1986-034-Granting Appeal Of Planning Commission Approval Of 3-Lot Subdivision In The R-1: 8000 Zone, Denying The Map And Directing The Applicant To File A Planned Development ApplicationRESOLUTION NO. 19R6 -34 RESOLUTION GRANTING APPEAL OF PLANNING COMMISSION APPROVAL OF A 3 -LOT SUBDIVISION IN THE R- 1:8000 ZONE, DENYING THE MAP AND DIRECTING THE APPLICANT TO FILE A PLANNED DEVELOPMENT APPLICATION (15313 Winchester Boulevard -- J.L.R. Properties) WHEREAS: 1. Thomas C. Suvada has appealed a decision of the Planning Commission as follows: approval of Subdivision Application M -85 -15 requesting a 3 -lot subdivision in the R- 1:8000 Zone on property located at 15313 Winchester Boulevard and owned by J.L.R. Properties; and 2. A public hearing was held by the Town Council on March 3, 1986. IT IS HEREBY RESOLVED: 1. The Town Council hereby finds that the Planning Commission erred in not considering the following: a. The 36 -foot wide street commitment previously made by the Town; b. Safety and parking issues related to the street width; C. Moving or replacing trees and the impact of the development on trees; and d. Lot B setback requirements as they relate to the possible mass of the building that might be proposed. 2. The Town Council further finds as follows: a. A maximum of three homes on the parcel may be acceptable; b. A new application should include a 36 -foot wide street with replacement landscaping for trees removed; C. The sidewalk should be continued around the cul -de -sac; d. Architecture and Site approval should be required for any structures to be placed on the property; e. A planned development application for a maximum of three dwellings may be appropriate. 3. Based on the foregoing findings, the appeal is hereby granted,, the tentative subdivision map is denied and the applicant is directed to file an application for a planned development. The fees for the planned development application and subsequent tentative map application based on planned development will be waived. Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review of the Town Council decisi n is governed by California Code of Civil Procedure Section 1094.6.
