RESOLUTION RESCINDING ROUTE 85 FREEWAY AGREEMENTS
BETWEEN THE TOWN AND THE STATE OF CALIFORNIA
WHEREAS:
1. The Freeway Agreement concerning State Highway Route 114
(now Route 85) was entered into and executed by the Town on
February 6, 1959; the Supplemental Freeway Agreement concerning
State highway Route 114 (now Route 85) was entered into and
executed by the Town on June 4, 1962; Town Resolution No. 1967 -13
authorized the Supplemental Freeway Agreements which supplemental
agreement was executed on March 28, 1967 concerning State Highway
Route 85; and Town Resolution No. 1970 -4 authorized the Freeway
Agreement concerning State Highway Route 85 and amending the 1959
agreement which agreement was executed on February 11, 1970; and
2. The Town is participating in the financing of State Highway 85
through Measure "A" funds; and
3. A public hearing was held on November 19, 1985, at which
significant impacts of proposed State Highway 85 were discussed
which were neither contemplated nor considered at the inception
of the freeway agreements in 1959, including impacts on housing,
traffic, noise pollution, air quality, and the financing mechanism
of Route 85.
IT IS HEREBY RESOLVED:
1. The Council finds that the freeway agreements authorizing
street closures, bypasses and highway interchanges no longer address
the current needs of the community;
2. The Council further finds that significant impacts need to be
considered today which were not contemplated or considered in 1959,
1962, 1967 or 1970; and
3. Based on the foregoing findings,

of the Town of Los Gatos held on the 2nd day of December 1 1985
