RESOLUTION REFERRING TO THE PLANNING COMMISSION THE
APPEAL OF THE DECISION OF THE PLANNING COMMISSION
DENYING ZONE CHANGE APPLICATION MODIFYING AN EXISTING
PLANNED DEVELOPMENT TO DELETE SENIOR CITIZEN OCCUPANCY
REQUIREMENTS.

WHEREAS:
1. Ali Mozaffari has appealed a decision of the Planning Commission as
follows: denial of Zone Change Application Z -82 -2B requesting modification
to an existing planned development to delete the requirements restricting
occupancy to senior citizens only for property located in the R- 1:8000 -PD
zone at 576 West Parr Avenue; and
2. A public hearing was held on September 16, 1985 and October 21, 1985;
and
3. The applicant indicated he wished to revise the proposal to allow for
retention of an all senior citizen project as a rental project but also to
retain the original plan as a development option;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission has not
reviewed the new proposal of applicant to retain the senior citizen project;
2. The Town Council further finds that the proposal requires modifications
to the Town Zoning Ordinance Nos.
3. The Council further finds that the parking needs for senior citizens
projects be examined to ensure all occupant and guest parking are adequate;
4. Based on the foregoing findings, the appeal is referred to the Planning
Commission for review of the new proposal, especially as to the adequacy
of parking and that the applicant's original plan remain as an option for the
development. The hearing on the Zone Change Application is continued to
December 2, 1985 and the report of the Planning Commission shall be filed by
said date.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos held on the __ 4th day of November , 1985
by the following vote:
