A RESOLUTION INITIATING PROCEEDINGS FOR THE
ANNEXATION OF CERTAIN UNINHABITED TERRITORY
DESIGNATED AS TOP OF THE HILL ROAD NO. 4 TO THE
TOWN OF LOS GATOS
RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa Clara,
State of California that
WHEREAS, the proposed annexation to the Town of Los Gatos consisting of all that
unincorporated territory known as Top of the Hill Road, No. 4, located along the
following streets:
Top of the Hill Road & Kennedy Road
in the County of Santa Clara is proposed for annexation to the Town of Los Gatos
pursuant to Part 2 of Title 4, Division 2, commencing with Section 35000 et seq. of
the Government Code; and
WHEREAS, it appears to the satisfaction of the Town Council that the owners of
land included in said proposal desire to annex to the Town of Los Gatos in order to
receive municipal services.
NOW, THEREFORE, the Town Council of the Town of Los Gatos of the County of Santa
Clara DOES HEREBY RESOLVE, DETERMINE and ORDER as follows:
1. The Town of Los Gatos is the conducting authority and hereby initiates
annexation proceedings pursuant to Section 35150.5 of the Government Code.
Proceedings of the Los Gatos Town Council will be held pursuant to Article
2 (commencing with Section 35220) of Chapter 3.
2. The territory proposed to be annexed is designated as Top of the Hill Road,
No. 4 Annexation, and the boundaries are described in the real property
description and map attached hereto marked Exhibits "A" and "B ",
respectively.
3. The territory proposed to be annexed is uninhabited as by Section 35038 of
the Government Code of the State of California.
4. The reason for the pr000sed annexation is to properly plan and provide
municipal services to the area which is already surrounded by the Town.
5. On December 2, 1985, at the meeting of the Town Council beginning at 7:30
p.m., in the Council Chambers of the Civic Center, 110 East Main Street,
Los Gatos, California, a public hearing will be held during which the Town
Council will hear protests against the annexation.
6. Since the territory is uninhabited, law provides that any owner of land
within the territory may file a written protest against the annexation with
the Town Clerk at any time prior to conclusion of the Town Council's
hearing on the proposed annexation.
7. The Town Council has determined that the annexation is Categorically Exempt
from the provisions of CEQA, California Administrative Code Section
#15319(x) and (b).
The Town Clerk is directed to cause notice of the hearing on the proposed
annexation to be given as provided in Section 35055 and 35223 of the Government
Code, and said notice shall include all the information specified in Section 35220
of the Government Code.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos held on the 21stday of October , 1985, by the following vote:

ANNEXATION DESCRIPTION
All that certain real property situated in the County of Santa Clara, State of
California, described as follows:
Beginning at the most southeasterly corner of that certain annexation to
the Town of Los Gatos entitled Top of the Hill Road #3, said point also
being on the easterly line of that certain annexation to the Town of Los
Gatos entitled Shannon Road #13, thence proceeding along the southerly line
of the Top of the Hill Road #3 annexation 247.68 feet to the true point of
beginning; thence continuing along the prolongation of last said line North
87' 58' 30" East 207.98 feet; thence North 1" 59' 23" West 26.00 feet;
thence North 87° 58' 30" East 206,18 feet; thence South 0° 35' 0" West
310.69 feet, said point also being on the northerly line of that certain
annexation to the Town of Los Gatos entitled Kennedy Road #7 and said point
also being located on the centerline of Kennedy Road; thence proceeding
along said northerly line of the Kennedy Road #7 annexation the following
courses and distances: South 80° 56' 11" West 252,43 feet; thence South
577 54' 01" West 124.30 feet, thence South 45° 52' 54" West 88.11 feet;
thence leaving said northerly line of the Kennedy Road #7 annexation North
0' 35' 0" East 417.06 feet to the true point of beginning.
Containing 3,214 acres more or less.
