RESOLUTION REFERRING TO THE PLANNING COMMISSION
THE APPEAL OF THE DECISION OF THE PLANNING COMMISSION
DENYING ARCHITECTURE AND SITE APPLICATION
AND VARIANCE APPLICATION

1. Applicant William L. Higgins has appealed a decision of the
Planning Commission as follows: denial of Architecture and Site
Application S-84-15 and Variance Application V-84-1 requesting approval of
plans to construct an additional office building and to waive screen wall
requirements on property in the "0" zone at 400 Blossom Hill Road; and
2. A public hearing was set by the Council for April 15, 1985, and
continued to May 6, May 20, July 1, July 15, August 3 and September 3,
1985, on which date the public hearing was held;
3. At the public hearing the Applicant offered to reduce the size of
the proposed building to 7000 square feet;
IT IS HEREBY RESOLVED:
1. The Council hereby finds that the project for a 7000 square foot
office building should be referred to the Planning Commission for further
review in connection with traffic safety considerations, such as left-
hand turns, and traffic capacity effects attributable to the project.
2. The Council further finds that the Planning Commission should
consider placing a convenant restricting further development of the parcel
in light of the traffic safety and traffic capacity considerations.
3. Based on the foregoing findings, the appeal is referred to the
Planning Commission to consider appellant's Architecture and Site
Application and Variance Application in accordance with Council direction.

the Town of Los Gatos held on the lffth day of September 1985 by
