A RESOLUTION OF INTENTION TO VACATE THE SANITARY SEWER
EASEMENT LOCATED AT 145 HAPPY ACRES ROAD (APN 537 -23 -058)
RESOLVED:
1, It is the intention of the Town Council to vacate, under the provisions of
Division 9, Part 3 (Sections 8300 through 8331) of the Streets and Highways Code, a
sanitary sewer easement situated in the Town of Los Gatos, County of Santa Clara,
State of California, consisting of a strip of land approximately 267.66 feet long
containing aooroximately 2,676.60 square feet located across APN 537 -23 -058, and
more particularly described in Exhibit "A" (Description of Sanitary Sewer Easement
to be Abandoned [145 Happy Acres Road] by the Town of Los Gatos), and Exhibit "B"
(Plat to Accompany Description of Sanitary Sewer Easement Abandonment), copies of
which are attached hereto, Said Exhibits show the particulars as to the proposed
abandonment, and are available for public inspection in the Office of the Town Clerk
of the Town of Los Gatos, Civic Center, 110 East Main Street, Los Gatos, California.
2. No easements shall be retained over the area to be abandoned.
3. On August 19, 1985, in the Council Chambers of the Civic Center, 110 East
Main Street, Los Gatos, California, the Town Council will hold a public hearing to
consider whether or not the easement is necessary for present or prospective public
use. The meeting will begin at 7:30 P.M. All persons interested are invited to
attend and he heard.
4. The Town Clerk is authorized, and is hereby directed to publish a copy of
this resolution in the Los Gatos Times, a newspaper of general circulation,
published and circulated in the Town of Los Gatos, within fifteen (15) days after
the date of its adoption.
5. The Mayor of the Town of Los Gatos is authorized, and is hereby directed to
execute that document entitled, "Notice of Abandonment of a Sanitary Sewer
Easement ", a copy of which is attached hereto, and the Town Engineer is authorized,
and is hereby directed to conspicuously post three (3) copies of said Notice, not
more than 300 feet apart, on at least ten (10) days before the date of the public
hearing above designated.

Gatos held on 15 day of July , 1985 by the following vote:

DESCRIPTION OF A SANITARY SEWER EASEMENT
TO BE ABANDONED AT 145 HAPPY ACRES ROD (APN -23 -058)

All that property situate in the Town of Los Gatos, County of Santa Clara,
State of California, being more particularly described as follows:
A strip of land 10.00 feet in width, the center line of which is
described as follows:
BEGINNING at the Southwesterly corner of that certain parcel of land
described as Parcel I in the deed from Edward Schwarz, et ux, to
Richard M. Salley, et ux, recorded December 23, 1966, in Book 7597 of
Official Records, page 256, Santa Clara County Records, said corner
being in the Northeasterly line of that certain 33.29 acre parcel of
land described as Parcel 1 in the deed from Lester R. Fink, et ux, to
Mission City Investors, Incorporated, a corporation, recorded June 16,
1960, in Book 4826 of Official Records, page 320, Santa Clara County
Records; thence from said point of beginning along said Northeasterly
line, South 72° 10' 53" East 60.00 feet to the TRUE POINT OF BEGINNING
of this description; thence from said true point of BEGINNING, LEAVING
SAID Northeasterly line, South 32° 20' 00" West 267.66 feet, more or
less, to a point in a Northerly line of that certain easement for
public street and road purposes (40 feet wide) as described in the
deed to Town of Los Gatos, a municipal corporation, recorded October
11, 1965, in Book 7136 of Official Records, page 33, Santa Clara
County Records, said point being the terminus of this easement; the
terminal lines for this easement being said Northerly line of said
easement for public street and said Northeasterly line of said 33.29
acre parcel.

SANITARY SEWER EASEMENT
NOTICE IS HEREBY GIVEN that on July 15 , 1985, the Town Council of the
Town of Los Gatos, County of Santa Clara, State of California, adopted
Resolution No. 1985 -105 entitled, "A RESOLUTION OF INTENTION TO VACATE THE
SANITARY SEWER EASEMENT AT 145 HAPPY ACRES ROAD (APN 537 -23 -058). A copy of
said Resolution No. 1985 -105, and a map entitled, "PLAT TO ACCOMPANY
DESCRIPTION OF SANITARY SEWER EASEMENT ABANDONMENT ", showing the particulars as
to the proposed vacation are on file in the Office of the Town Clerk of the
Town of Los Gatos, Civic Center, 110 East Main Street, Los Gatos, California,
and are available for inspection during regular business hours.
NOTICE IS FURTHER GIVEN that on August 19, 1985 in the Council Chambers of
