DENIAL OF ZONE CHANGE APPLICATION REQUESTING
CHANGE IN ZONE FROM R-1:6000 TO R-1:8000-PD
TO PERi1IT A 4-LOT SINGLE FAMILY SUBDIVISION
(16313 Winchester Boulevard--J.L.R. Properties)
WHEREAS:
1. Joseph H. Vila, partner of J.L.R. Properties, has appealed a
decision of the Planning Commission as follows: Denial of Zone Change
Application Z-bb-] requesting a change in zone from R-1:8000 to R-1:8000
PD to permit a 4-lot single family subdivision on property located at
15x13 Winchester Boulevard; and
2. A public hearing was Held by the Town Council on flay 20, 1985.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission
committed no error.
2. The Town Council further finds that the findings of the Planning
Commission were correct as follows: Since the property could not be
divided into four lots and meet the Town's setback requirements for the
existing zoning, the concern about density, protection of the quality of
the neighborhood aria neighborhood equity is a basis for denial of the zone
change.
3. The Town Council further finds that the decision of the Planning
Commission was correct to deny the zone change application.
4. based on the foregoing findings the appeal is hereby denied.
5. Pursuant to Los Gatos Town Code Section 1-15, the time for seeking
judicial review for the Town Council decision is governed by California
Code of Civil Procedure Section IU94.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of
the Town of Los Gatos held on T—day of June 1985 by
the following vote:
