RESOLUTION REFERRING TO THE PLANNING COMMISSION THE APPEAL
OF THE DECISION UP THE PLANNING COMMISSION
DENYING ARCHITECTURE AND SITE APPLICATION
AND VARIANCE APPLICATION
(400 Blossom Hill Road -- William L. Higgins)
WHEREAS:
1. Applicant William L. Biggins has appealed a decision of the
Planning Commission as follows: denial of Architecture and Site
Application S -84 -15 and Variance Application V -84 -1 requesting approval of
plans to construct two office buildings and to waive screen wall
requirements on property in the "0" zone at 4UU Blossom Hill Road; and
2. A public hearing was held by the Council on December 3, 1984;
IT IS HEREBY RESOLVED:
1. The Council hereby finds that applicant's offer to reduce the size
of the project presents an amendment to the project not discussed by the
Planning Commission or reviewed by the Development Review Committee.
2. The Council further finds that review of the reduced project
should include the following:
a. reexamination of the left turn into the property in light of
the reduced scale;
b. limitations on phasing the development of the property; and
C. variance of the masonry wall separating the applicant's
property and the adjacent property.
s. The Council further finds that if the Planning Commission denies
the applications, the precise reasons for denial should be stated
including, but not limited to, traffic impacts of the proposed development
as well as the physical structure and the location of the structure.
4. Based on the foregoing findings, the appeal is referred to the
Planning Commission to consider appellant's Architecture and Site
Application and Variance Application after receiving the specified report
from the Development keview Committee.
PASSEU AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gastos held on the 17th day of December 1984 by the
following vote:
