RESOLUTION GRANTING APPEAL FROM DECISION OF
BUILDING OFFICIAL THAT ALL SANITARY FACILITIES
BE HANDICAPPED ACCESSIBLE IN A NEW OFFICE BUILDING
(15000 Los Gatos Boulevard - Live Oak Medical)
WHEREAS:
1. Ray Murdock has appealed a decision of the Building Official as
follows: requiring all five sanitary facilities to be handicapped
accessible in the new office building at 15000 Los Gatos Boulevard; and
2. A public hearing was held by the Town Council on October 1, 1984.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds as follows:
a. Three of the five sanitary facilities in the new office
building will be made handicapped accessible.
b. These three sanitary facilities are adjacent to public
waiting areas.
C. The two non - handicapped accessible facilities will not
be in the normal path of travel of patients and will be
used by doctors only for their personal use and will be
so designated.
d. The State Architect has interpreted Title 24 of the
California Administrative Code on handicapped access
regulations that private sanitary facilities which are
not made available to the public, clients or employees
need not comply with State handicapped access regulations.
e. Pursuant to California Heath and Safety Code Section 19957,
making three out of five sanitary facilities handicapped
accessible provides equivalent facilitiation and a practical
hardship exists in making the other two sanitary facilities
handicapped accessible due to the amenities applicant seeks
to provide to doctors using such two sanitary facilities.
2. Based on the foregoing findings, the appeal is granted as follows:
a. Three sanitary facilities for public use must be made handicapped
accessible; and
b. Two sanitary facilities for the personal use of doctors must be
so designated and need not be made handicapped accessible.
Pursuant to Los Gatos Town Code Section 7 -15, the time for seeking
judicial review of the Town Council decision is governed by California
Code of Civil Procedure Section 7094.6.

the Town of Los Gatos held on the 15th day of October , 7984
by the following vote:
